      <title>Statement made by SDPU(U) concerning attempts to foil National referendum on Ukraine’s membership in NATO and participation in CES</title>

      <description>As is well known, from November 2005 till February 2006 109 officially registered initiative groups collected signatures in support of the National referendum on Ukraine’s membership in NATO and its participation in the Common Economic Space with Russia, Byelorussia and Kazakhstan. Putting forward the initiative to hold the referendum the SDPU(U) proceeded from the fact that the Ukrainian people have a constitutional right to decide their own future. And that any crucial decisions must be made only at national referendums which are of direct action and which any authorities are to implement. Having set a course for Ukraine’s hasty integration into the military and political bloc NATO which they view as a guarantee of preserving their status the authorities completely ignore the fact that the majority of our citizens resolutely oppose this course. Simultaneously, the authorities openly block development of any relations within the framework of the CES agreement signed with Russia, Byelorussia and Kazakhstan which leads to negative consequences for Ukraine’s economy. The Ukrainian people actively supported the initiative to hold the National referendum – over 4.6 million people had put their signatures in its support by March 1, 2006. Yet, since the very beginning of the process the local authorities and law-enforcement bodies have been making attempts to foil the referendum. One can easily guess that the whole process is coordinated from the President’s Secretariat. These actions that have no legal grounds and contradict the law are aimed at discrediting the idea itself of the referendum and foiling it. Statements and comments made by representatives of the prosecutor’s office that appear in the media from time to time also serve this aim. Although under the law the CEC was to make a decision on the issue by April 1, it has not made it yet. At the same time, representatives of the prosecutor’s office and deputy chairman of the CEC Mr. Melnyk continue making statements on alleged violations registered during the collection of signatures in some oblasts. Mr. Melnyk who represents in the CEC a well-known political force obviously fulfils somebody’s order. We have evidence showing that abusing power he personally exercised pressure on people urging them to recall their signatures. We sent an enquiry to the General Prosecutor’s office in this relation asking it to give an evaluation of his actions. We remind that according to the Law “On National and Local Referendums” heads of local councils bear responsibility for the collection of signatures and verification of their authenticity. We claim we have legal evidence showing that people were forced to recall their signatures in the oblasts that were mentioned in the comments made by the press service of the General Prosecutor’s Office. And today in these oblast members came under pressure: they are invited for interrogations and forced to recall their signatures. In Rivne I.Olshanetskyi, the prosecutor of the town, illegally verifies the results  of the collection of signatures, collects information about activists of local initiative groups. Neither is the role of national deputy from “Our Ukraine” S.Oleksiuk clear. He personally “checked” the lists that were kept in the local council . In Khmelnytskyi O.Torkalo, the prosecutor of the town, and his assistant V.Baliuk are illegally verifying the results of the initiative groups’ activity with the help of Interior Ministry officials. For example, Y.Hulu, an official of the town department of the Interior Ministry interrogates members of initiative groups. The situation in Mykolayiv is similar, initiators of the National referendum are invited to the prosecutors’ office for interrogations. It shows that the authorities are doing their best to foil the referendum and deprive the Ukrainian people of their constitutional right to determine their own future. We resolutely oppose lawlessness that jeopardizes not only the Ukrainian people’s democratic right to decide their own future but also the very existence of democracy itself in our country. Arbitrariness the present-day authorities allow themselves under the guise of democracy and cynicism with which that talk so much about caring about Ukrainian citizens’ rights and freedom show that they failed to stand the test of democracy. We appeal to the Ukrainian President to urgently put an end to arbitrariness and request that as the guarantor of the Ukrainian Constitution he protect the rights of millions of Ukrainians who put their signatures in support of the National referendum and ensure free expression of citizens’ will.</description>
